1. Acceptance of Terms
By accessing and using Biddigo ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. Biddigo reserves the right to modify these terms at any time, and your continued use of the Platform constitutes acceptance of any modifications.
2. Platform Description
Biddigo is an online marketplace that connects buyers and sellers of used vehicles in Australia. We facilitate vehicle inspections, PPSR checks, and secure payment processing. Biddigo acts as an intermediary and is not a party to the actual sale transaction between buyers and sellers.
3. User Accounts
To use certain features of the Platform, you must create an account. You agree to:
- Provide accurate and complete information during registration
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Be responsible for all activities under your account
4. Listing and Selling Vehicles
Sellers on Biddigo agree to:
- Provide accurate and truthful information about their vehicle
- Have legal authority to sell the vehicle
- Ensure the vehicle is free from undisclosed encumbrances
- Cooperate with the inspection process
- Honor winning bids that meet or exceed the reserve price
5. Bidding and Buying
Buyers on Biddigo agree to:
- Place bids in good faith with the intention to complete the purchase
- Have the financial means to complete transactions
- Complete payment within the specified timeframe after winning an auction
- Pay applicable buyer fees (2.5% success fee)
6. Fees and Payments
Biddigo charges a 2.5% success fee to buyers on completed transactions. Sellers list and sell vehicles at no cost. All payments are processed through our secure escrow system. Funds are held until both parties confirm successful handover of the vehicle.
7. Inspections and PPSR
All vehicles listed on Biddigo undergo independent inspection and PPSR verification. While we strive for accuracy, these reports are provided for informational purposes. Buyers should conduct their own due diligence before purchasing.
8. Limitation of Liability
Biddigo provides the Platform "as is" and makes no warranties regarding the condition of vehicles, accuracy of listings, or outcome of transactions. To the maximum extent permitted by law, Biddigo shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform.
9. Dispute Resolution
In the event of a dispute between buyers and sellers, Biddigo may, at its discretion, assist in mediation. However, Biddigo is not obligated to resolve disputes and is not responsible for the actions of users.
10. Governing Law
These Terms of Service are governed by the laws of Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Australia.
